GeltUp – Terms of Service

Welcome to GeltUp ("GeltUp," "we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the GeltUp website, platform, and services (collectively, the "Platform").

By accessing or using GeltUp, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

1. About GeltUp

GeltUp is a crowdfunding platform that allows individuals and nonprofit organizations to raise funds for personal, community, or charitable causes.

Donations made through GeltUp are processed by third-party payment processors such as Stripe and PayPal.

GeltUp facilitates the collection and processing of donations for campaign organizers through integrated payment providers. Payments are intended to be directed to the campaign organizer’s connected payment account, less applicable fees.

2. Eligibility

To use GeltUp, you must:

  • Be at least 18 years old
  • Have the legal capacity to enter into a binding agreement
  • Comply with all applicable U.S. federal, state, and local laws

By using the Platform, you represent and warrant that you meet these requirements.

3. User Accounts

To create a campaign, you must create an account on GeltUp and provide accurate and complete information.

You are responsible for:

  • Maintaining the security of your account
  • All activities that occur under your account
  • Ensuring your campaign information is truthful and lawful

GeltUp reserves the right to suspend or terminate accounts that violate these Terms.

4. Campaign Creation

Campaign creators ("Organizers") may create fundraising campaigns for lawful purposes only.

By creating a campaign, you agree that:

  • All information provided is accurate and not misleading
  • You are authorized to raise funds for the stated purpose
  • You will use the funds only as described in your campaign

Nonprofit organizations may be required to provide additional information, such as a Tax ID number, to indicate tax-deductible eligibility.

Approved nonprofit organizations may also create ongoing or daily donation pages, subject to GeltUp review and approval.

GeltUp does not guarantee campaign success and does not verify the legitimacy of campaigns unless required by law or platform policy.

GeltUp reserves the right to review, pause, or remove campaigns at its sole discretion, including in cases of reports, compliance checks, or suspected misuse.

5. Donations

Donors may contribute to campaigns voluntarily. Donations are:

  • Processed securely through Stripe or PayPal
  • Processed through GeltUp’s payment integrations and directed to the campaign organizer’s connected payment account
  • Subject to applicable platform and payment processing fees

GeltUp does not guarantee how organizers will use donated funds and is not responsible for organizer actions.

GeltUp provides the platform for fundraising but does not guarantee that campaigns will receive donations or reach their fundraising goals.

Organizers are solely responsible for the use, management, and distribution of funds raised through their campaigns.

6. Fees

GeltUp charges:

  • A 2% platform fee on each donation
  • Plus standard payment processing fees charged by Stripe or PayPal (currently around 2.9%)

Donors are not required to cover platform fees. Fees are automatically deducted before funds reach the organizer.

7. Payment Processing

All payments are processed by third-party providers (Stripe and PayPal). By using GeltUp, you agree to their terms and policies.

GeltUp:

  • Does not store full payment details
  • Uses secure payment providers to process transactions
  • Facilitates the transfer of funds to campaign organizers through integrated payment providers
  • In certain cases, payment flows may involve temporary processing through GeltUp’s payment infrastructure before being directed to the organizer
  • Is not responsible for payment processor errors or delays

GeltUp may request or initiate a temporary delay or review of transfers through its payment providers in cases of compliance review, suspected fraud, disputes, or legal requirements.

Payment Processor Requirements

Campaign organizers must create and maintain a valid account with GeltUp's payment processors (such as Stripe or PayPal) in order to receive funds.

These payment processors may impose their own terms, verification requirements, fees, payout schedules, and compliance checks.

GeltUp does not control and is not responsible for decisions made by payment processors, including but not limited to account verification, payment delays, chargebacks, account suspensions, or payout holds.

8. Refunds

Refunds may be issued by the campaign organizer and/or the payment processor (Stripe or PayPal), in accordance with their policies.

GeltUp may assist in facilitating refunds in certain cases, including disputes, fraud, or compliance reviews.

GeltUp does not guarantee refunds and may participate in refund decisions where required.

9. Tax Deductibility

Some campaigns may indicate that donations are tax-deductible.

GeltUp does not provide tax advice and does not verify tax deductibility beyond the information provided by organizers.

Donors are responsible for consulting a tax professional.

10. Prohibited Activities

You may not use GeltUp to:

  • Engage in fraud, deception, or misleading practices
  • Raise funds for illegal or harmful activities
  • Infringe intellectual property rights
  • Harass, abuse, or harm others

GeltUp reserves the right to remove campaigns or suspend accounts at its discretion.

11. Intellectual Property

All content on GeltUp, including logos, design, and software, is owned by GeltUp or its licensors.

Users retain ownership of content they submit but grant GeltUp a non-exclusive, royalty-free license to display and promote campaigns.

12. Platform Availability & MVP Disclaimer

GeltUp may offer features in beta or MVP (Minimum Viable Product) form. Some features may be incomplete or unavailable.

We do not guarantee uninterrupted or error-free service.

13. Limitation of Liability

To the maximum extent permitted by law, GeltUp shall not be liable for:

  • Loss of funds
  • Misuse of donations by organizers
  • Technical issues or downtime
  • Disputes between donors and organizers

Use of the Platform is at your own risk.

14. Indemnification

You agree to indemnify and hold harmless GeltUp from any claims arising out of:

  • Your use of the Platform
  • Your campaign or donations
  • Your violation of these Terms

15. Termination

GeltUp may suspend or terminate your access at any time if you violate these Terms or applicable laws.

16. Governing Law

These Terms are governed by the laws of the United States, without regard to conflict of law principles.

17. Changes to These Terms

We may update these Terms from time to time. Continued use of GeltUp after changes constitutes acceptance of the updated Terms.
